Abstract

Indian wage law used to be a genuine mess. Four separate statutes, each with its own habit, meant employers spent more time figuring out which rule applied than actually paying people fairly and plenty of workers simply slipped through the gaps between them. The Code on Wages set out to fix this by folding all four into one statute. What I find most significant though isn't the consolidation itself but who now falls under it: - the Code widens the definitions of "employer" and "employee" enough that formal and informal workers finally sit under the same protective framework. Parliament passed it back in 2019, yet it sat unenforced for six years before finally taking effect on 21 November 2025, alongside the three other labour codes.
